1. Introduction: At Same Page Caregiving, your privacy is not just a legal obligation — it is a core value. We understand that the information you share within our platform is deeply personal, and we are committed to handling it with the utmost care, respect, and transparency. This Privacy Policy explains what information we collect, how we use it, and the choices you have regarding your data. 2. Information We Collect: Information You Provide Directly Account — name, email address, and phone number. Profile information — your role as a caregiver and relationship to the care recipient. Care recipient information — name, date of birth (only if entered on an uploaded document), medications, medication-administration records (including clinical readings you log), such as blood-glucose values recorded alongside a dose), and care preferences you choose to enter, together with any information you enter in free-text needs and preferences fields. Care team information — names and contact details of family members and caregivers you invite. Content you create — calendar entries, task lists, journal entries, uploaded documents, messages, and audio recordings of care visits together with written transcripts generated from them. Payment information — billing details for paid subscriptions (processed securely through a third-party payment processor). Information Collected Automatically- Device information — device type, operating system, and browser type. Usage data — that the app was opened. Log data — access times, and error reports. Error reports include technical details when something goes wrong, with personal and health information removed before the error reports are sent. Cookies and tracking technologies — used to keep you signed in and to remember which Care Circle you were last viewing. 3. How We Use Your Information: We use the information we collect to: Provide, maintain, and improve the Service, Facilitate care coordination among your care team, Send appointment reminders, task notifications, and care updates, Process payments and manage your subscription, Respond to your questions and provide customer support, Send important updates about the Service or these policies, Analyze usage patterns to improve app features and user experience, Comply with applicable laws and legal obligations. 4. How We Share Your Information: We do not sell, rent, or trade your personal information. We may share your information only in the following limited circumstances: With your care team — information you post within the platform is visible to the care team members you have invited and authorized. With service providers — trusted vendors who act on our behalf and at our direction to help us operate the Service, such as cloud hosting and database services, transactional email and text-message delivery, audio transcription of care visits, payment processing, and product analytics and error monitoring, under strict confidentiality agreements. For legal compliance — if required by law, court order, or governmental authority. For safety — if we believe disclosure is necessary to protect the rights, safety, or property of Same Page Caregiving, our users, or the public. In a business transfer — in the event of a merger, acquisition, or sale of assets, your information may be transferred with advance notice to you. For purposes of this Policy, “third party” does not include vendors that process information solely on our behalf and at our direction. Phone numbers and SMS opt-in data collected for SMS communications will not be shared, sold, or disclosed to any third parties or affiliates for marketing or promotional purposes. 5. Health & Sensitive Information: Same Page Caregiving is not a HIPAA-covered entity and is not subject to HIPAA requirements. However, we recognize the sensitive nature of health-related information and apply the following protections: Health information you enter is used solely for your personal care coordination. Health information is never sold or shared with advertisers or data brokers. Health information is encrypted in transit and at rest, and access is limited to the members of your care circle. You are in control of what health information you choose to enter and share. Where the Service records and transcribes a care visit, it does so only after asking whether everyone present agrees to be recorded and recording that response; if consent is declined, no recording is made. 6. Data Storage & Security: We take the security of your data seriously. Our safeguards include: Encryption of data in transit and at rest, Secure access controls and authentication requirements, Limited employee access to personal data on a need-to-know basis. While we implement industry-standard security practices, no system is completely secure. We use one-time codes sent to your email address to sign you in, rather than passwords, so we encourage you to keep your email account secure and to protect the devices you use to access the Service. If we discover a breach of security involving the unauthorized acquisition of the unsecured identifiable health information, we will notify you without unreasonable delay and no later than sixty (60) calendar days after discovery, and will notify regulators and other parties where required by law. 7. Data Retention: We retain your personal information for as long as your account is active or as needed to provide the Service. If you request deletion of your account: Your profile will be removed from view in the Care Circle within 30 days of receipt of the request and purged from routine backups after 7 days. Your name will no longer appear in the Care Circle’s member list, and your phone number will be removed. Entries that you wrote – care notes, tasks, and appointments – keep your name on them, so the Circle maintains a record of who did what that stays accurate. You are able to download a full record of your data from the account menu any time before your account is removed. Some information may be retained longer if required by law or for legitimate business purposes, including limited delivery records held by our email and text-message providers under their own standard retention periods. Anonymized, non-identifiable data may be retained for analytical purposes. 8. Your Rights & Choices: You have the following rights regarding your personal information: Access — request a copy of the personal information we hold about you, Correction — request correction of inaccurate or incomplete information that was entered, Deletion — request deletion of your personal information, Portability — you can download a copy of your own account data at any time. Open the account menu at the top of any screen (the circle with your initial) and choose ‘Download my data’, Opt-out — unsubscribe from non-essential communications at any time, Withdraw consent — withdrawing consent for health information stops any new health information being added to your circle. Information already in the care record stays available to your caregiving team. To exercise any of these rights, contact us at the information provided in Section 13. 9. Children's Privacy: Same Page Caregiving is not directed at children under the age of 13. We do not knowingly collect personal information from children under age 13. If you believe a child has provided us with personal information, please contact us immediately and we will take steps to delete it. Children under age 13 should not be listed as Care Recipients. 10. Cookies & Tracking Technologies: We use cookies and similar technologies to enhance your experience. You may control cookie settings through your browser preferences. Disabling cookies may affect certain features of the Service. 11. Third-Party Links & Resources: Our Service may contain links to third-party websites and resources. This Privacy Policy does not apply to those sites. We encourage you to review the privacy policies of any third-party sites you visit. 12. Changes to This Privacy Policy: We may update this Privacy Policy from time to time. When we do, we will post the revised Policy here and update the “last updated” date below. If we make material changes, we will provide notice through the app or by email before those changes take effect. Where a change materially expands how we collect, use, or share health-related information, we will obtain consent of the Care Recipient or their healthcare surrogate before applying that change to information that has been collected, to the extent required by applicable law. Your continued use of the Service after a change takes effect constitutes acceptance of the updated Policy, except where we are required to obtain your consent. 13. Terms of Service 1. Acceptance of Terms: By accessing or using the Same Page Caregiving application or website ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. 2. Description of Service: Same Page Caregiving is a family care coordination platform designed to help family caregivers stay organized, communicate, and coordinate care for a loved one. Features may include but are not limited to: Shared care calendars and scheduling, Medication and task tracking, Team communication and updates, Document and health record storage, Family Care team management. 3. Eligibility: You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that you meet this requirement. Same Page Caregiving is intended for personal, non-commercial family caregiving use. The Service is offered to, and intended for use by, residents of the United States only. It is not intended for use by individuals located or residing outside the United States, nor by residents of the State of Washington. By using the Service, you represent that you are a resident of the United States and are not a resident of the State of Washington. We do not intend to offer or direct the Service to individuals in the European Union, the European Economic Area, the United Kingdom, or the State of Washington, and any access from those jurisdictions is unintended. 4. Account Registration: To access certain features in the application, you must create an account. You agree to: Provide accurate and complete information during registration, Keep your account credentials confidential and secure, Notify us immediately of any unauthorized use of your account, Be responsible for all activity that occurs under your account. Same Page Caregiving reserves the right to suspend or terminate accounts that violate these Terms. 5. Care Team & Invited Users: Same Page Caregiving allows you to invite family members, friends, and other caregivers to join your care team. By inviting others, you: Confirm that you have obtained that person’s permission before sharing their contact information with us, and that you will not invite any person who has asked not to be contacted, Understand that invited users will have access to information you choose to share within the platform based on permissions granted, Accept responsibility for managing the appropriate access levels of your care team members. 6. Privacy & Health Information: Your privacy is important to us. Please review our Privacy Policy, which is incorporated into these Terms by reference. You acknowledge that: Same Page Caregiving is not a covered entity under HIPAA and does not provide medical advice. Information shared within the platform is for personal care coordination purposes only. You are responsible for what health and personal information you choose to share within the platform. We will handle your data in accordance with our Privacy Policy. 7. Acceptable Use: You agree to use the Service only for lawful purposes. You agree not to: Use the Service to harass, harm, or intimidate any person, Share false, misleading, or harmful information, Attempt to gain unauthorized access to any part of the Service, Use the Service for any commercial purpose without written consent, Upload or share content that violates any applicable law or third-party rights, Attempt to reverse engineer, copy, or replicate the Service. 8. Intellectual Property: All content, features, and functionality of Same Page Caregiving — including but not limited to text, graphics, logos, and software — are the exclusive property of Same Page Caregiving and are protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission. 11. Subscription & Payments: Some features of Same Page Caregiving application may require a paid subscription. By subscribing, you agree to: Pay all applicable fees as described at the time of purchase, Authorize us to charge your selected payment method, Receive advance notice of any changes to subscription pricing, Understand that subscription fees are non-refundable except where required by law. If you purchase an annual subscription for a single Care Circle and the care recipient dies, you can request a partial refund of the annual amount paid by emailing us at the email below. If you have paid an annual subscription for 2 or more care circles, and drop to 1 care circle due to a death of a care recipient another circle, please email us to request a prorated change to subscription cost of your account. Your annual subscription amount will be prorated to the annual subscription rate for a single care circle remaining until the remaining balance is used, then your payments will resume for the single care circle. 12. Termination: You may cancel your account at any time. Same Page Caregiving reserves the right to suspend or terminate your access to the Service at our discretion, including for violations of these Terms, with or without notice. Upon termination: Your access to the Service will cease, You may request export of your data prior to termination, Certain provisions of these Terms will survive termination. 13. Limitation of Liability: To the fullest extent permitted by law, Same Page Caregiving shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability to you for any claims arising from these Terms shall not exceed the greater of (a) the amount you paid to us in the twelve months preceding the claim or (b) one hundred dollars ($100). Nothing in this section limits or excludes liability for gross negligence, willful misconduct, or fraud; for death or personal injury caused by our negligence; for your indemnification obligations; or for any other liability that cannot be limited or excluded under applicable law. 14. Disclaimer of Warranties: The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. Same Page Caregiving does not warrant that the Service will be uninterrupted, error-free, or completely secure. 15. Indemnification: You agree to indemnify, defend, and hold harmless Same Page Caregiving and its officers, directors, members, employees, processors, and agents from and against any claim, demand, loss, liability, damage, cost, or expense (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms or of any applicable law; (c) information you enter about any other person, including any care recipient, emergency contact, or invited user; (d) your representation that you hold authority to enter information about a care recipient; (e) any contact information you provide to us for another person; or (f) any audio you record or submit through the Service. 16. Governing Law & Dispute Resolution: These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky, without regard to its conflict of law provisions. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved as follows: (a) Informal resolution — you agree to first contact us so that we may attempt to resolve the dispute informally; (b) Mediation — if informal resolution fails, the dispute will be submitted to mediation in Jefferson County, Kentucky; and (c) Binding arbitration — if mediation fails, the dispute will be resolved by final and binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration shall be conducted in Jefferson County, Kentucky, and judgment on the award may be entered in any court of competent jurisdiction in Jefferson County, Kentucky. The parties acknowledge that this Agreement evidences a transaction involving interstate commerce, and that the Federal Arbitration Act, 9 U.S.C. § 1 et seq., governs the interpretation and enforcement of this arbitration provision. YOU AND SAME PAGE CAREGIVING AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Notwithstanding the foregoing, either party may bring an individual claim in small claims court, and either party may seek injunctive relief in court to protect its intellectual property rights. If the class-action waiver in this section is found unenforceable, the entirety of this arbitration provision shall be null and void. 17. Changes to These Terms: Same Page Caregiving reserves the right to update these Terms at any time. We will notify you of material changes by email or in-app notification before those changes take effect. End User Agreement
1. Agreement: Overview This End User License Agreement ("Agreement") is a legal agreement between you ("User") and Same Page Caregiving ("Company") governing your use of the Same Page Caregiving mobile application and website ("Application"). By downloading, installing, or using the Application, you agree to be bound by this Agreement. 2. License Grant Subject to the terms of this Agreement, Same Page Caregiving grants you a: Limited — only for your personal caregiving use, Non-exclusive — others may also be granted the same license, Non-transferable — you may not transfer this license to another person, Revocable — we may terminate this license if you violate this Agreement license to download and use the Application on devices you own or control. 3. Permitted Uses: You may use the Application to: Coordinate care for a loved one with your personal care team, Manage caregiving schedules, tasks, and medications, Communicate and share updates with invited care team members, Access caregiving resources and educational content provided within the Application. 4. Restrictions: You agree that you will not: Copy, modify, or distribute the Application or its content, Reverse engineer, decompile, or attempt to extract the source code, Rent, lease, lend, sell, or sublicense the Application to any third party, Use the Application for any commercial purpose without written authorization, Remove or alter any proprietary notices or labels on the Application, Use the Application in any way that violates applicable local, state, or federal laws, Attempt to gain unauthorized access to any servers or networks connected to the Application, Use automated tools, bots, or scripts to access or interact with the Application. 5. Ownership & Intellectual Property: The Application and all of its content, features, and functionality are and will remain the exclusive property of Same Page Caregiving. This Agreement does not transfer any ownership rights to you. All rights not expressly granted are reserved by Same Page Caregiving. 6. User-Generated Content: You retain ownership of the content you create within the Application. By entering content, you grant Same Page Caregiving a limited license to store, display, and transmit your content solely for the purpose of providing the Service to you and your care team. You represent and warrant that: You have the right to share any content you enter into the Application, Your content does not violate any third-party rights or applicable laws, You will not enter content that is harmful, false, or inappropriate. 7. Updates & Changes to the Application: Same Page Caregiving may from time to time: Release updates, patches, or new versions of the Application, Add, modify, or remove features, Temporarily suspend the Application for maintenance. Continued use of the Application following updates constitutes acceptance of any revised terms. 8. Subscription & In-App Purchases: Certain features require a paid subscription. All purchases are: Processed through the applicable app store (Apple App Store or Google Play) or our website Subject to the payment terms of the respective platform and are Non-refundable except as required by law or the applicable platform's refund policy. You may cancel your subscription at any time through your account settings or the applicable app store. 9. Termination: This Agreement is effective until terminated. Same Page Caregiving may terminate this Agreement and your access to the Application immediately if you: Violate any provision of this Agreement, Engage in conduct harmful to other users or the Company, Fail to pay applicable subscription fees. Upon termination, you must cease all use of the Application and delete all copies from your devices. 10. Disclaimer of Warranties: The Application is provided "as is" without warranty of any kind. Same Page Caregiving expressly disclaims all warranties, whether express, implied, or statutory, including but not limited to: Warranties of merchantability or fitness for a particular purpose, Warranties that the Application will be uninterrupted or error-free, Warranties regarding the accuracy or reliability of any content within the Application. 11. Medical Disclaimer: Same Page Caregiving is a care coordination tool only. It is not intended to replace professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider for medical decisions. Do not delay seeking medical attention based on information within the Application. 12. Limitation of Liability: To the maximum extent permitted by applicable law, Same Page Caregiving shall not be liable for: Any indirect, incidental, or consequential damages, Loss of data, revenue, or profits, Damages arising from your reliance on information within the Application, Any interruption or cessation of the Service. Our total liability to you shall not exceed the greater of (a) the amount you paid for the Service in the twelve months preceding the claim or (b) one hundred dollars ($100). Nothing in this section limits or excludes liability for gross negligence, willful misconduct, or fraud; for death or personal injury caused by our negligence; for your indemnification obligations; or for any other liability that cannot be limited or excluded under applicable law. 13. Indemnification: You agree to indemnify, defend, and hold harmless Same Page Caregiving and its officers, directors, employees, and agents from any claims, damages, or expenses — including reasonable attorney's fees — arising from: Your use of the Application, Your violation of this Agreement, Your violation of any third-party rights, Any content you submit through the Application. 14. Governing Law & Dispute Resolution: This Agreement shall be governed by the laws of the Commonwealth of Kentucky. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved as follows: (a) Informal resolution — you agree to first contact us so that we may attempt to resolve the dispute informally; (b) Mediation — if informal resolution fails, the dispute will be submitted to mediation in Jefferson County, Kentucky; and (c) Binding arbitration — if mediation fails, the dispute will be resolved by final and binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. If the class-action waiver in this section is found unenforceable, the entirety of this arbitration provision shall be null and void. 15. Entire Agreement: This Agreement, together with the Terms of Service and Privacy Policy, constitutes the entire agreement between you and Same Page Caregiving regarding the Application and supersedes all prior agreements. In the event of a conflict among these documents, the following order of precedence applies: (1) this Agreement; (2) the Terms of Service; and (3) the Privacy Policy, except that the Privacy Policy controls on all matters concerning the collection, use, and disclosure of personal information. 16. Changes to This Agreement: Same Page Caregiving reserves the right to modify this Agreement at any time. We will provide notice of material changes by email or in-app notification before those changes take effect. Your continued use of the Application after a change takes effect constitutes your acceptance of the modified Agreement. 17.
